Terms of Service

Definitions

Commission - The authorization of the production of a service or good (Equipment, work of art)Commissioner (hereafter "you", "client") - an individual giving the order for the production of an artist's work.Invoice - A list of goods and services with a stated sum; a "bill".WIP (or "Work in Progress") - an unfinished subject of development.By contracting "Charlibarli" (hereafter "I", "Me", "Charlie") you agree to the written terms of service. These terms may change at any time as needed.

Age Requirement

All clients are required to be 18 years of age minimum in order to purchase a commission. In addition, you must be the minimum age of your country, region, province, state, or local government to be considered "Age of Majority". In cases where these conflict, you must default to the highest age requirement present.I retain the right to refuse any client I suspect of being in violation of this term.

Usage Standards

By commissioning a service from me, clients agree to not use any part of this service and end-product in activities considered:
> Unlawful or otherwise against the terms of service.
> Abusive, harassment, threatening, impersonation, or intimidating against persons and/or marginalized groups.
> Defamatory, obscene, profane, or infringement of existing copyright.
> Promotion or training of Artificial Intelligence models.

Artificial Intelligence Policy

By commissioning a service from me, clients agree that the final artwork, along with any sketches or WIPs, may not be used, whole or in part, for any purpose relating to Artificial Intelligence. This includes:
> Training or tuning models (diffusion models, LoRAs, embeddings or any derivative method).
> Usage in "img2img" and derivative methods in personal or commercial models.
> Alteration or "upscaling" through services that record input images into data sets meant for training.
> Inclusion in any database training set intended for Artificial Intelligence, public or private.This applies in any context. Regardless of personal, commercial, open-source or proprietary. Violation of this term will result in the refusal of any future commissions, and immediate revocation of rights over the commission without refund.

Alteration Policy

Finished commissions may be altered and edited, provided that it is not achieved through an Artificial Intelligence model, and my signature or watermark remains visible. Should a client crop the commission in a way that removes the watermark or signature, plain-text attribution to me is an acceptable alternative. In no way may the watermark or signature be altered in any way, in a manner misrepresenting the artist.Tracing (Manual and digital, without the assistance or use of Artificial Intelligence), especially in the context of learning, is allowed, so long as credit is provided to me if it is posted onto social media.

Usage Rights

Unless otherwise specified, I retain the full usage rights of any creation made. This includes advertising, merchandising, and posting to social media.In addition, the commissioner is granted non-transferable personal (non-commercial) use rights of said creation. Commercial rights are to be discussed prior to commission, and must exist in a valid and auditable contract.

Attribution

I prefer that works commissioned through me are attributed reasonably. This may exist in the form of links to an account I operate, social media "tagging", or plain-text reference to "Charlibarli".

Refund Policy

Full refunds are valid until after the preliminary sketch is completed and the work is started. From that point onward, a 50% refund is offered. Refunds are not offered after a commission is completed and approved.
